      I dunno how it works now, but I had to have Cornell Legal Aid and a banker’s box FULL of evidence from my doctor to get me past the first two rubber stamp denials.

      CLA told me if I was denied again, after my hearing at which I was represented by a Cornell Law student, they would not take me any further.

      However, we were treated so badly – both myself and my law student – that when CLA heard her report and then listened to the recording of my hearing, they were steaming at the ears and swore to take my case as far as it had to go to get me justice.

      My third refusal was followed by a fourth, which CLA told me was typical. The first and second are done by the first level and the second is usually rubber stamped, then for the third, you get to appear before a judge who is PAID BY SOCIAL SECURITY TO REFUSE PEOPLE, and that denial is followed by another rubber stamping by another in house judge.

      I had to get to the fifth level – a federal judge outside the Social Security system – before I got my case actually heard on a fair and unbiased basis. The federal judge’s ruling was very terse, less than two pages, which CLA told me boiled down to a lot of legalese for, “Quit yanking this woman around and pay her, assholes.”

      I have an incurable illness, but still have to go back every three years to prove I’m still disabled. Maybe now I’m pushing 60, they’ll leave me alone. Or maybe not. I’m white.

      • Yeah, that figures — the person with the genuine disability gets put through the meat grinder, and meanwhile there are able-bodied people scamming the system who give everyone on disability a black eye.

        Still, I can’t help feeling some sympathy for people who are not actually disabled — at least not in the sense we usually think of disability — but who have no marketable skill, can’t find a job in this horrible economy, and their unemployment has run out. In a normal, healthy economy, many (if not most) of them would be able to find someone who would hire them. But in the midst of an economic depression, with obamacare mandates looming and employers refusing to hire, it must seem totally hopeless. Someone comes along who tells them he can get them on disability, and they go along with it because they’re desperate. If I were in their position and had no other options, I’m sure I would be tempted to do the same.

          My pastor actually criticized my even applying, because hubby was able-bodied and working. Except his income was $500 a month LESS than we needed for our totally no frills life.

          The only reason we have had vehicles that run during these past 20 years is that relatives have repeatedly give us their still good used vehicles rather than trade them in when they upgraded. I’m talking THREE TIMES this has happened … D’s dad, his brother and then one of our girls.

          But never mind that. The fact is that Social Security Disability INSURANCE was something I’d paid into, so I asked the pastor if his car got totaled and he could afford a new one without insurance, would he make a claim? He said, Of course. It’s insurance. Yeah, well. I qualified. We needed the money. And IT WAS INSURANCE we had had no choice about purchasing.

          • I agree absolutely. I have several other friends who also receive SSDI — they also paid into the system for many years, can no longer work due to genuine disability, and depend on SSDI for survival. It’s sad that those who are using it the way it was intended to be used get lumped in with the leeches who are just scamming the system.

            An architect friend of my husband’s suffered a severe head injury on the job about a year ago and has been unable to work since. The physical and mental consequences of his injury have been devastating, and architecture isn’t something you can do when your brain isn’t functioning at full capacity. But he has a wife and a bunch of kids to support, so he’s collecting SSDI. Now they want to kick him off of it because they’ve seen him doing things like taking his kids to school, which supposedly proves that he’s not disabled. If you’re well enough to take your kids to school, that must mean you’re well enough to be designing buildings that won’t collapse on people’s heads. Maybe it seems that way to someone who has never designed a building and has no idea how difficult it is. The point is that because there are scammers bilking the system, it casts suspicion on everyone who collects SSDI, including the ones who need to be on it and have no other means of survival. That’s what really ticks me off.

              That was the gist of my hearing. The judge was just VILE to me. The lady who typed the transcript of my hearing whispered to me when I came in to sign some stuff that she just wanted me to know how bad she felt for me just from listening to the recording of my hearing.

              IKWYM about appearances too. I have good days and people don’t get it that being able to get dressed and go out and do SOMETHING, see people, be a little useful, maybe OMG have a smitch of FUN, is a rare and wonderful thing.

              Even my lawyer didn’t get it; when she came to interview me, I was sewing and lucid. So a strong friend took the two of us to the mall where I walked around with them without my carbon filter mask and oxygen tank. She watched as my mental, emotional and physical abilities deteriorated until I was laying down on a bench, weeping and demanding my friend give me a shot like he’d promised. I think when he promised he didn’t think he’d actually have to, but I needed it to get vertical enough to get out of the mall and go home again … where I was incapacitated for days from the stress.

              When my dad died, the guy across the street stopped in to offer condolences and expressed surprise Pop had been that sick, since he had just seen him out in the yard a few days before he died and he’d seemed well. I said, “I am also up, dressed and out of the house, so you probably can’t tell that I’m chronically ill, mostly homebound and often bedridden. It’s called HAVING A GREAT DAY.” To his credit, he admitted he hadn’t thought of that.

              I had neighbors tattling to an agency I was applying to for help that they had seen me “running around in the field out back” so therefore I must be crazy or faking and therefore the help I needed (for my kids, who were all pre-schoolers) was clearly not in order. I still don’t get how the young children of a crazy lady don’t need help, but never mind that. The fact is I had WALKED across the back yard and HELD THE STRING OF A KITE for a while so hubby and the girls could enjoy a bit of Chrissy time out of doors.

              It didn’t make me capable of being a full time mother to 3 tiny ones and I really did need the day care assistance. As for the neighbors, not one of them ever darkened my doorstep OR ASKED what my condition was or anything else. In fact, I bumped into one of them at the mailboxes after 3 years living next door to him and he finally did ask what the name of my disorder was. That is the only convo I had with the man before they moved away. Yet his wife was one of the tattlers.

              • People who have been blessed with good health — well, some of them, anyway — have an unfortunate tendency to think that people who are chronically ill are just hypochondriacs. I have seen this attitude many times. And no, they don’t understand the concept of a sick person having an occasional good day. They think that if you can be up and around once in a while, you should be able to do it all the time.

                Some people also seem incapable of understanding that just because there are people who scam the system, it doesn’t mean everyone who participates in the program is faking it. There are probably many genuinely disabled people who have been kicked off the rolls because of the tattling of ignorant people like your neighbors.

                • Really true. I confess that this is one of the things that make me cringe about some conservatives, especially the ones focused on the self-sufficiency aspect. They often say things that show they have no concept that there’s ever any need for legitimate dependency. I guess once they were out of the womb and got out on their own after being dependent for over a decade, they promptly forgot about it. Some of these people are well into their 70’s, and yet they have no clue about the profound dependency that awaits them, or they have some twisted idea of ending it all the moment they become a burden, which is one of the most unChristian and idiotic ideas ever. Every philosophical stripe has its idiots, I guess.

              • Chrissy, don’t you just love it when neighbors turn each other in to the authorities for things they can’t possibly really know about? Or for minor things that don’t hurt anything. It just seems that your neighbors are important (you might depend on them!), and one of the best ways to hurt them (and anger them) is to get them in trouble for stupid things. I know it may be necessary in serious cases, but most of the one’s I’ve seen were ridiculous. Makes me wonder what it will be like if Obama gets his way and has neighbors spying on each other for owning (gasp) guns or (horrors) using too much electricity or water. From what I’ve seen, there are millions out there who will be only too happy to squeal on all of us.

Did you notice Obama is just furthering Bush’s same policies and eroding our freedom? Do you know every president since LBJ has been a puppet for an Oligarchy that runs all the world’s reserve banks and prints it’s own money, lends it out to us at interest and since the gold standard was abolished the only way to pay it back is with more printed debt loaned to us at interest.
